Donald Trump's Second Impeachment (Part 1) - The Attack & The Vote
You probably knew this article was coming soon. Since this a political topic, I will try to remain as neutral as possible even though I lean towards Biden more than Trump. This is also a situation that is intensifying and brewing at the hour. So for the purpose of this article and the understanding of you the reader, this article was written on the 14th of January 2021 and publish at approximately 1830 hrs. So brace yourself please.
What is Impeachment?
Impeachment is extremely complicated and hard to understand. (To simplify, I can't be bothered to read through Article One of the United States constitution) But I do understand at least the basics of impeachment. Here goes nothing.
The idea of Impeachment begins with Impeachment hearings by the house committee on rules and judiciary. Take them as the headmaster reviewing a bully in school. They will examine facts and allow for impeachment hearings. Then a few representatives come together to draft up an article or a few articles of impeachment. That or those articles go to the US House of Representatives which are filled with 433 representatives. (as of 2021, 2 seats has not been called in the 2020 election, but usually there are 435 seats) To pass and impeach a president, a majority is needed. If a majority votes 'yea' in the house, the articles goes to the United States Senate where a trial begins. The trial is basically a debate between a group of people selected for the prosecution and the president's lawyers. After all the boring debates, the senate votes on the trial. However, instead of a simple 50% majority, a super majority or 2/3 of the senate has to vote in favour of the trial for the president to be removed from immediate effect. If not, nothing happens and the president is acquitted from all articles.
Over the course of the United States 230+ years of history, only two presidents have been impeached but both have been acquitted. The two were Andrew Johnson in 1868 and Bill Clinton in 1998. While Richard Nixon resigned from office after impeachment hearings began on the issue of the infamous Watergate Scandal in 1974 and knowing he would have been convicted and removed from office.
Donald Trump First Impeachment (2019)
Donald Trump has been impeached before in 2019 for abuse of power and obstruction of congress over that suspicious call with Ukraine president Volodymyr Zelensky. The house adopted both articles and trial began in the senate. After boring exchanges between Trump's two lawyers, Rudy Giuliani and John Eastman and the managers committee. In the end, Trump was acquitted and not guilty for both articles. That was it. He joined the list under 'Impeached President'
Donald Trump Second Impeachment (2021)
Let's begin with why impeachment? Well for those living under a rock, the United States Capitol Riots, which occurred on January 6, 2021, the day the election results, which Trump had claimed and filed lawsuits against, would be certified that Joe Biden and Kamala Harris was the official winners by Congress. Some of his most loyal allies had pledged to overturn the election results including one Mike Pence who Trump had personally pressured in different rallies to declare him the winner. Trump had held a rally on the same day in front of a huge crowd in Washington D.C. He personally ordered supporters to march into congress while they were certifying the election results.
Trump went downhill from there. From being personally banned from Twitter and having loyal allies going against him. One such ally is very prominently Mike Pence who declared Biden and Harris the winner of the results saying and I quote "To those who wreaked havoc on our nation's capitol today, you did not win. Violence never wins. Freedom wins. And this is still the People's House." Congress continued to certify the results and those who allied with Trump decided not to overturn the election.
From there, Congress had a few ways to react to the riot and to Trump's actions. One, was to pressure Trump to resign. Two, Congress could use the 14th amendment to disqualify Trump from office. Three, they could use the 25th amendment, basically stripping Trump from all powers in office while keeping him in office. Finally, Impeachment.
There was also no official hearing put together by a committee. Instead, speaker of the house Nancy Pelosi just ordered a vote in the house and an article of impeachment to be written. The one article of impeachment, incitement of insurrection was voted on and passed 232-197 in the house. In total, all Democrats and 10 Republicans voted for it. Pelosi signed it and Trump became the first president to be impeached twice. As of writing this, a senate trial has not been planned.
Farren's Opinion Corner
In my opinion, I think it was probably a given he would be in hot waters, impeachment or no impeachment. But I do feel slightly mixed about the impeachment. As I am a slight Biden supporter myself, I feel I am in an interesting experience. Firstly, I support the impeachment while on the other hand, I feel his last days in office will be written into US history forever, they will be bad days for Trump supporters and glory days for Biden supporters.
